Terms and Conditions
These terms and conditions set out the basis on which you buy from us and we sell to you turf, topsoil and lawn products through this website. When you buy turf and products through Turfshop, you enter a legally binding agreement with us. You should read these terms and conditions in full because they affect your rights and liabilities. - Definitions and basis of sale
a. In these terms and conditions, the following definitions apply: Tillers Turf Company Ltd (Company number 2336318) is referred to as “the company”) Turfshop.co.uk is referred to as “Turfshop”. A customer buying turf and products through Turfshop is referred to as “the customer”. b. Any placement of an order by the customer via Turfshop signifies the customer’s acceptance of these terms and conditions in full. c. These terms and conditions can only be varied by a Director of the company in writing. - Ordering and payment
a. Turf and Topsoil prices quoted on Turfshop include delivery to the address specified by the customer and VAT. b. Payment must be made in full by the customer at the time of ordering any turf and products via credit or debit card. c. Orders must be placed on Turfshop by 12 noon on the day preceding the day the customer requires turf and products to be delivered, or earlier. For Saturday deliveries, orders need to be placed by 12 noon on the preceding Thursday, or earlier. Delivery is not available on Sundays, Mondays and certain other days as notified on Turfshop. d. Orders can only be accepted by the company where there is adequate access for delivery to the address specified by the customer. In the absence of such access, the company reserves the right to refuse or cancel orders without notice. e. Advice and information given by the company relating to the characteristics and suitability of its products for particular applications is for guidance only, and accordingly no warranty is given, whether express or implied, as to quality or fitness for purpose. f. a. All turf supplied will be cultivated turf, which has been sown and maintained to produce a strong, healthy sward. Measures will be taken by the company during the growing period to control weeds and disease. The turf can not be guaranteed free of Poa annua (annual meadowgrass) as this species can come in to turf at any time through seeds borne on air as well as in soil. Turf, as a natural and growing product, will, also, be subject to some variation and so absolute consistency within and between orders can similarly not be guaranteed. b. For turf supplied to form a successful new grass area, the customer will need to follow the company’s advice set out on Turfshop for preparing the site on which the turf is to be laid, and then for laying and maintaining the turf thereafter. Any complaints by the customer (see section 5 below) will be invalid if this advice is not followed in full. c. Turf supplied is at the customer’s risk from the time of delivery. After this time, the company will have no further liability for the turf or for any loss or damages connected with its use. d. The company may vary the seed mixtures used to grow turf sold via Turfshop. Where such variation does not materially affect the suitability of turf for indicated uses, such variation will not constitute grounds for any claim by the customer. e. The size, weight and measure of turf rolls quoted on Turfshop may vary due to turf being a natural product. - Topsoil and lawn products supplied
a. Topsoil and lawn products will be sourced only from reputable national suppliers with the aim always of supplying high quality. b. Topsoil, being a natural product, will be subject to variation in particle shape, size and colour. c. Many of the lawn products supplied will be subject to manufacturers’ guarantees. If products do not come with such a guarantee, then Turfshop will warrant their quality and specification. d. Topsoil and lawn products supplied are at the customer’s risk from the time of delivery. After this time, the company will have no further liability for the products or for any loss or damages connected with their use. - Delivery
a. The customer, or his/her representative, must be at the delivery address to receive and sign for turf and/or other products supplied. b. Delivery of palleted products, for instance turf and topsoil, will be on a kerbside basis to the address specified by the customer in an accepted order. It is up to the customer to move turf and/or products from kerbside to the position where they are to be used. Other products will be delivered by post or courier to the customer’s door. c. The company will endeavour at all times to deliver turf and products on the date specified by the customer in an accepted order. Where, however, due to circumstances beyond the company’s reasonable control, delivery is delayed, the company will not be liable for any damages resulting. d. In order to make deliveries, the company will need good access for delivery vehicles. It is the responsibility of the customer to alert the company to potential access difficulties (by email (info@turfshop.co.uk) or by phone 01652 678000 (between 9am and 5pm Monday to Friday)) so that the company can assess whether an order can be accepted. If an order has been placed by the customer and then normal delivery is found to be impossible for reasons which were not specified on Turfshop at the time of order, the company will try to make the delivery in another way or at another time, but any extra costs arising will be charged to the customer. e. The company will not accept liability for damages or injury caused to property or persons during delivery. - Any problems
a. The company’s aim is always to give complete satisfaction to the customer. If a customer is in any way dissatisfied with the turf or other products supplied or with associated services, such as delivery, he/she should contact the company by phone or email in the first instance – 01652 678000 (between 9am and 5pm Monday to Friday) or info@turfshop.co.uk. b. If turf or other goods received are damaged or defective in any way, then Turfshop will refund the customer or provide replacement products. Goods may need to be returned or other evidence supplied in order for a customer to receive a refund or replacement. Click here to see the company’s Returns and Cancellation Policy. c. In the event of goods supplied being damaged or defective or in the event of other complaint, the company’s liability will not extend to consequential damage. d. The company will not be responsible for any defects in turf supplied arising from inadequate site preparation, laying or maintenance of the turf by the customer. e. The company will not be responsible for any failure of a product to meet its specification or to perform as it should due to manufacturers’ instructions not being followed in full.
These terms and conditions will be governed by English law and any disputes will be resolved by the English courts.
